Terms of Use and Participation for the Designer Extra Creamy Prize Draw

From 23 September 2026 to 14 October 2026 (the "Entry Period"), Fitmart GmbH & Co KG, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany ("we" or "us") is running the Designer Extra Creamy Prize Draw (the "Prize Draw"). Entry to the Prize Draw takes place via the ESN online shop.

1. Who can take part in the Prize Draw?

Eligible to participate are all natural persons who have reached the age of 18 at the time of entry and are resident in Germany, Austria, Switzerland, the Netherlands, France, Spain, or the United Kingdom. By entering, you accept these Terms of Use and Participation.

Employees of Fitmart GmbH & Co KG or of any company affiliated with us, as well as other persons involved in developing and running this promotion, are excluded from participation.

2. During which period can I take part in the Prize Draw?

The Entry Period begins on 23 September 2026 at 6:00 p.m. and ends on 14 October 2026 at 5:30 p.m.

3. How does entry work?

To take part in the Prize Draw, you must meet the following conditions within the Entry Period:

Product purchase: You must purchase at least one ESN Designer Extra Creamy in the full-size 480g variant (the "Promotional Product") in the ESN online shop.

Opt-in: You must actively consent to participation in the Prize Draw during the checkout process.

Entry within the Entry Period is only possible once per person and order e-mail address. If a person places several qualifying orders, only one entry will be counted.

If an order is fully cancelled or returned under the statutory right of withdrawal, meaning the Promotional Product is no longer kept, eligibility to participate in the Prize Draw lapses.

Entry is only possible in your own name. This may result in provider-dependent costs to you (e.g. for your internet connection).

All data collected will be used exclusively for determining and delivering the prizes. We process this data in accordance with applicable legal requirements.

4. When and how are the winners determined?

Winners will be drawn at random from all eligible participants after the standard withdrawal and returns period has expired. Winners will be notified by e-mail within 14 days of the draw.

5. What prizes are there?

Fitmart GmbH & Co. KG is giving away the following prizes among all eligible participants:

1st prize (awarded 10 times): 1x Ninja Creami ice cream maker worth €269

2nd prize (awarded 100 times): 1x ESN Designer Extra Creamy Launch Box worth €83.70 (pre-configured, cannot be modified)

A total of 110 prizes will therefore be awarded. Only one prize per person is possible.

Note on Prize 1 (Ninja Creami): Whichever Ninja Creami model is currently available at the time of shipping will be sent. The Prize Draw has no connection to SharkNinja Operating LLC or the Ninja brand and is neither sponsored, endorsed, nor organised by them.

Note on Prize 2 (Extra Creamy Launch Box): The specific contents of the Launch Box are determined by the organiser and cannot be individually customised.

Prizes in kind will be shipped by post to an address provided by the winners.

6. How is my data processed?

Information on data processing can be found in the Privacy Policy.

We process the data solely to carry out and administer the Prize Draw pursuant to Art. 6(1)(b) GDPR. Data provided as part of the Prize Draw will be deleted — subject to statutory retention obligations — once the purpose of processing this data no longer applies or the data is no longer required for that purpose.

You may withdraw your consent to participate in the Prize Draw at any time. You can do so by e-mail to the contact address stated in the Privacy Policy, or via the opt-out link in any e-mail we send you. Withdrawal ends your eligibility to participate.

7. Miscellaneous

Prizes cannot be paid out in cash. Prizes cannot be exchanged for other services or prizes. Prizes are non-transferable. From the time the prize notification is sent, winners have two weeks to accept their prize by replying to the e-mail from Fitmart GmbH & Co. KG with their postal address. If a winner fails to do so, or if it is not possible to notify the winner of their prize, the prize is forfeited and will be awarded to another participant in accordance with the procedure described above. The same applies in the event the prize cannot be delivered or is returned. The participant is solely responsible for the accuracy and completeness of the contact details provided.

Winners are solely responsible for any taxation of their prize. Should individual provisions of these Terms of Participation be or become invalid, the validity of the remaining Terms of Participation shall remain unaffected. Recourse to legal action is excluded. These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

8. Can I be excluded from the Prize Draw?

A breach of these Terms of Participation entitles us to exclude you from taking part in the Prize Draw. This applies in particular where false information is provided or third-party rights are infringed (e.g. personality or copyright rights).

In addition, we may exclude participants who manipulate or attempt to manipulate the entry process, and/or breach these Terms of Participation, and/or otherwise attempt, in an unfair or improper manner, to influence the Prize Draw or its administration, in particular by interfering with the software used. In such cases, prizes may also be revoked and reclaimed retroactively.
