Terms and Conditions of Participation in the ESN Designer Bar Community Voting Competition
From April 15, 2026, to June 09, 2026 (hereinafter referred to as the "Participation Period"), Fitmart GmbH & Co. KG, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (hereinafter referred to as "we" or "us") will run the ESN Designer Bar Community Voting Competition (hereinafter referred to as the "Competition"). Participation in the Competition takes place on the website https://www.esn.com/pages/designer-bar-voting (hereinafter referred to as the promotion website).
All questions, comments, remarks, and complaints about the Competition should be sent via email to service@esn.com.
By entering this Competition, you agree to these terms and conditions and any decisions reached by us in this regard, which are final and binding in all matters related to this Competition. In addition, by entering this Competition, you hereby warrant that all information submitted by you is true, current and complete. We reserve the right to verify the eligibility of all participants and disqualify a participant for submitting false information.
1. Who Can Participate in the Competition?
All natural persons who are at least 18 years old at the time of participation and have a residence in Germany, Austria, Switzerland, France, the UK or the Netherlands are eligible to participate. By filling out the Typeform (which can be found at the promotion website: https://www.esn.com/pages/designer-bar-voting), you accept these terms and conditions of participation.
Employees of Fitmart GmbH & Co. KG or any affiliated company, as well as individuals involved in the development and execution of this promotion, are excluded from participation.
2. When Can I Participate in the Competition?
The Participation Period begins on April 15, 2026, at 6:00 PM and ends on June 09, 2026, at 12:00 AM (midnight).
3. How Does Participation Work?
3.1 Online Participation:
To participate in the competition, you must purchase at least 1x12 ESN Designer Bar Dark Chocolate Raspberry and 1x12 ESN Designer Bar White Chocolate Raspberry (hereinafter referred to as “promotional products”) in the ESN online shop during the specified promotional period. After the purchase, a link to the promotional page https://www.esn.com/pages/designer-bar-voting will be sent to you via the ESN CRM system. In the next step, you must enter your contact details (email address, name, and age) in the online participation form (Typeform) and take part in the voting.
Participation is only possible if the email address used in the online participation form matches the email address used for your order. This is the only way to verify that the above participation requirements have been met. Participation during the Participation Period is therefore limited to one entry per email address used.
Multiple entries using the same email address are not permitted and will result in disqualification from the competition. Email addresses that cannot be linked to a completed order are also not permitted and will likewise result in disqualification from the giveaway.
Participation is only allowed in your own name and exclusively online via the promotional page. Provider-dependent costs may arise (e.g., for internet connection). The participation form must be completed in full so that we can notify you in the event of a win.
All collected data will be used exclusively for determining and delivering the prizes. This data will be processed in compliance with legal regulations.
Winners will be selected by lottery. The prize draw will take place after successful verification of all relevant data using a random selection process. Winners will be notified by email by June 30, 2026.
3.2 Event Participation (Exception Rule)
Event participation in the giveaway includes voting at FIBO Cologne (Fitness & Bodybuilding Expo, April 16–19, 2026, Cologne exhibition grounds). In this case, you must fully register and vote at the promotional booth. In this scenario, purchasing the promotional products is not required. Multiple participation (event and online) is not permitted.
4. What Are the Prizes?
Fitmart GmbH & Co. KG will award the following prizes among all participants:
1st Prize (1 winner): A one-week trip* including flights (economy class), accommodation (4-star hotel), and extras to Los Angeles, United States of America, for 2 people.
*The travel period, flight times/departure airport, hotel selection, and specification of extras will be arranged between the winner and the organizer. The final decision lies with the organizer. The entry requirements for the USA at the time of travel apply. Any visa costs must be borne by the winner.
2nd Prize (5 winners): A one-year supply of ESN Designer Bars (2x12 bars per month, for 12 months)
3rd Prize (10 winners): An ESN product package worth €200 (pre-configured, no possibility of modification)
5. How Is My Data Processed?
Information on data processing can be found in the Privacy Policy.
We process data solely for the execution and handling of the Competition in accordance with Art. 6(1)(b) of the GDPR. Any data collected for the purpose of the Competition will be deleted—subject to statutory retention obligations—once the purpose has been fulfilled or is no longer required.
6. Miscellaneous
Prizes cannot be exchanged for cash or other rewards. Prizes are for personal use only and are not for resale. Prizes are non-transferable. Winners must confirm their acceptance of the prize within two weeks of receiving the notification email from Fitmart GmbH & Co. KG by replying with their postal address. If a winner fails to respond within two weeks or cannot be contacted, the prize will be forfeited and awarded to another participant using the same selection method. The same applies if a prize is undeliverable or returned. Physical prizes will be sent by mail to the address provided by the winners. Winners are responsible for any applicable taxes on their prizes.
If any provision of these terms and conditions becomes invalid, the validity of the remaining terms remains unaffected. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
7. Can I Be Disqualified from the Competition?
A violation of these participation terms and conditions entitles us to disqualify you from the Competition. This applies particularly in cases of false information or infringement of third-party rights (e.g., personal or copyright rights).
Additionally, participants may be disqualified if they manipulate or attempt to manipulate the participation process or the Competition website, violate these participation terms, or try to unfairly influence the Competition in any unfair or dishonest manner, particularly by disrupting the software used. In such cases, winnings may be revoked and reclaimed even after the Competition has ended.
